Welcome to CUTEYE. These Terms and Conditions (“Terms”) govern your access to and use of the CUTEYE website, online marketplace, products, and services. By accessing the website, creating an account, placing an order, or selling through the marketplace, you agree to these Terms.

  1. About the Marketplace

CUTEYE LLC operates an online marketplace where customers may purchase products offered by CUTEYE and independent third-party sellers.

Independent sellers are responsible for the accuracy, quality, safety, legality, packaging, and fulfillment of the products they list. CUTEYE may assist with marketplace transactions and customer service, but independent sellers are not employees or agents of CUTEYE.

  1. Eligibility and Accounts

You must be at least 18 years old or have the permission and supervision of a parent or legal guardian to use the marketplace.

You agree to provide accurate, complete, and current information when creating an account. You are responsible for protecting your password and for all activity performed through your account.

CUTEYE may suspend or close accounts involving fraud, abuse, unlawful activity, policy violations, or risks to customers, sellers, or the marketplace.

  1. Product Listings

We make reasonable efforts to display product descriptions, photographs, colors, prices, and availability accurately. However, colors and product appearances may vary depending on the device or screen used.

Independent sellers are responsible for their product listings. CUTEYE may correct errors, remove listings, request additional documentation, or cancel transactions involving inaccurate, prohibited, unsafe, counterfeit, or unlawful products.

Product information provided on the website is for general informational purposes and is not medical advice. Customers should review product labels, ingredients, warnings, and instructions before use.

  1. Orders and Acceptance

Submitting an order does not guarantee acceptance. An order may be refused or canceled because of product unavailability, pricing errors, suspected fraud, payment problems, shipping restrictions, or policy violations.

If a paid order is canceled, the appropriate refund will be issued to the original payment method.

Customers are responsible for providing a complete and accurate billing and shipping address.

  1. Prices, Payments, and Taxes

  1. Returns, Refunds, and Cancellations

Returns, refunds, exchanges, and cancellations are governed by the CUTEYE Returns Policy and any clearly disclosed seller-specific conditions that comply with marketplace rules and applicable law.

Certain products may not be returnable for health, hygiene, safety, personalization, or final-sale reasons. Any applicable restrictions should be disclosed before purchase.

Customers should contact CUTEYE promptly if an item arrives damaged, defective, incorrect, or materially different from its listing.

  1. Seller Responsibilities

Marketplace sellers agree to:

  • Provide accurate business, identity, payment, tax, and contact information.
  • List only authentic, lawful, safe, and accurately described products.
  • Maintain sufficient inventory and fulfill orders promptly.
  • Follow applicable product, labeling, consumer-protection, tax, shipping, privacy, and intellectual-property laws.
  • Protect customer information and use it only to fulfill orders and provide related customer service.
  • Follow the CUTEYE Seller Guidelines and marketplace policies.
  • Pay all disclosed marketplace fees and commissions.

CUTEYE may remove products, hold payments when reasonably necessary, cancel transactions, or suspend seller accounts for policy violations, fraud, excessive complaints, or legal and safety concerns.

  1. Prohibited Conduct

Users and sellers may not:

  • Engage in fraud, deception, harassment, or unlawful activity.
  • List counterfeit, stolen, unsafe, recalled, prohibited, or illegally obtained products.
  • Infringe trademarks, copyrights, patents, privacy rights, or other rights.
  • Interfere with website security or attempt unauthorized access.
  • Upload viruses, malicious code, false reviews, or misleading content.
  • Use customer information for unauthorized marketing.
  • Attempt to avoid marketplace fees by improperly moving marketplace transactions off the website.
  1. Reviews and User Content

If you submit reviews, photographs, comments, or other content, you confirm that the content is accurate, lawful, and does not violate another person’s rights.

You grant CUTEYE permission to display, reproduce, and use submitted content for operating and promoting the marketplace. CUTEYE may remove content that is false, abusive, unlawful, irrelevant, or otherwise inappropriate.

  1. Intellectual Property

The CUTEYE name, logo, website design, original content, graphics, and other brand materials are owned by or licensed to CUTEYE LLC and may not be copied, sold, or used without written permission.

Independent sellers retain responsibility for obtaining permission to use all photographs, brand names, descriptions, and other materials contained in their listings.

  1. Third-Party Services and Links

The website may contain links to or integrations with third-party services, payment providers, shipping companies, or websites. CUTEYE is not responsible for the availability, content, policies, or practices of third parties.

  1. Disclaimer of Warranties

To the fullest extent permitted by law, the website and marketplace are provided on an “as available” and “as is” basis. CUTEYE does not guarantee uninterrupted access, error-free operation, or that every product offered by an independent seller will meet every customer’s expectations.

Nothing in these Terms limits rights or warranties that cannot legally be excluded.

  1. Limitation of Liability

To the fullest extent permitted by law, CUTEYE LLC will not be liable for indirect, incidental, special, or consequential damages arising from the use of the website, marketplace, third-party services, or products sold by independent sellers.

Nothing in these Terms excludes liability that cannot legally be limited or excluded.

  1. Indemnification

To the extent permitted by law, sellers agree to defend and indemnify CUTEYE LLC against claims, losses, damages, and reasonable expenses arising from their products, listings, conduct, legal violations, or breach of these Terms.

  1. Privacy

The collection and use of personal information are governed by our Privacy Policy.

  1. Changes to These Terms

CUTEYE may update these Terms periodically. Updated Terms will be posted on this page with a revised “Last updated” date. Continued use of the marketplace after an update constitutes acceptance of the revised Terms.

  1. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally may be brought before a court with appropriate jurisdiction in Miami-Dade County, Florida, unless applicable law requires otherwise.
